Information on the processing of personal data pursuant to articles 13-14 EU Reg. 2016/679 | Interested Subjects: customers.
Bluvacanze S.p.A. in its capacity as Data Controller of your personal data, pursuant to and for the effects of EU Reg. 2016/679 hereinafter ’GDPR’, hereby informs you that the aforementioned legislation provides for the protection of data subjects with respect to the processing of personal data and that this treatment will be based on principles of correctness, lawfulness, transparency and protection of your privacy and your rights.Your personal data will be processed in accordance with the legislative provisions of the aforementioned legislation and the confidentiality obligations set forth therein. Processing purposes: your data will be processed for the following purposes:
a) related to the implementation of obligations relating to contractual and pre-contractual obligations:
- Fulfillment of the travel contract, stipulated by the tourist for single service or package sale;
- After-sales assistance;
- Customer care;
- Customer management;
- Detection of the degree of customer satisfaction.
b) Related to the execution of legal obligations:
- Compulsory obligations by law in the tax and accounting field;
- Litigation management;
- Customer billing history.
c) Connected to the execution of the legitimate interest of the Data Controller, as expressly recognized by the art. 130, paragraph 4, of Legislative Decree 196/2003 (so-called "Privacy Code"):
- Limited to the e-mail address you provided in the context of the purchase of a tourist package \ service from Bluvacanze, the latter may use this e-mail address to send promotional communications (including the "newsletter") of products and/or services similar to those offered to you and/or purchased by you without the need for your express and prior consent, without prejudice to your right to oppose such use at any time (so-called "soft spamming") by writing to rpdblu@bluvacanze.it .
d) For the purposes of the indicated processing, the Data Controller may become aware of particular categories of personal data and in detail: particular data only if communicated by the interested party, State of health (e.g. handicapped person, celiac, etc.). The processing of personal data for these particular categories is carried out in compliance with Article 9 of the GDPR and with your consent. If, for the purposes indicated in the information notice, if You communicate personal data of third party family members to the Data Controller, it means that You have personally proceeded with the request consent to the processing of their data and provided them with this information. The provision of data for this purpose is optional, but could compromise the correct management of the travel execution relationship.
e) Subject to your consent for marketing purposes through traditional methods (e.g. telephone contact, paper mail, individual e-mails, etc.) or automated contact methods (e.g. automated campaigns for sending e-mails, SMS, automated telephone contact, instant messaging, social networks, etc.).
The provision of data for this purpose is optional, and your refusal to process does not compromise the continuation of the relationship or the adequacy of the processing itself.
Processing methods: your personal data may be processed in the following ways:
- Assignment of processing operations to third parties.
- Collection of data by computer or telematics.
- Cookies as indicated in the cookie policy available on the site.
- Automated call tools (e.g. e-mail, sms, mms and similar).
- Treatment by means of electronic calculators.
- Manual treatment by means of paper archives.
- Newsletter reports and promotional communications and takes advantage of the reports connected to these systems. Thanks to these reports, the Data Controller can know, for example: the number of readers, the number of e-mails opened, the details of the e-mails sent by date, hour, minute, the details of the e-mails delivered or not and of those forwarded, the list of those who have unsubscribed from the newsletter, those who have opened an e-mail or clicked on a single link, users with problems viewing messages.
Each treatment takes place in compliance with the methods set out in the articles. 6, 32 of the GDPR and through the adoption of the appropriate security measures envisaged.
Communication: your data will be communicated exclusively to competent and duly appointed subjects for the performance of the services necessary for the correct management of the contractual relationship, with a guarantee of protection of the rights of the interested party.
Your data will be processed only by personnel expressly authorized by the Data Controller and, in particular, by the following categories of employees:
- Commercial Offices,
- Marketing Office,
- Administration Office.
Your data may be communicated to third parties who will act as independent Data Controllers or who will be appointed as Data Processors, in particular to:
- Public and/or private subjects for whom the communication of data is mandatory or necessary in compliance with legal obligations or it’s in any case functional to the administration of the contractual relationship,
- Forwarders, Carriers, Owners, Post Offices, Logistics Companies,
- Consultants and freelancers, also in associated form,
- Banks and credit institutions, including PayPal, Visa, Mastercard or American Express circuits for payment by credit card or prepaid credit card,
- Insurance companies and third parties, even non-EU, for the completion of the reservation,
- Company part of the same Bluvacanze Group,
- External companies necessary for the fulfillment of the purposes indicated in this statement. The company has adopted appropriate contractual clauses with these companies or appointments as external data processors.
- To the family members of the interested party in the event of extraordinary events (natural disasters, wars, etc.). This consent is mandatory by virtue of the seriousness of the events for which the communication is made
- Third parties who operate as independent Data Controllers for obligations related to the management of the stipulated contract.
- External companies necessary for the fulfillment of the purposes (even optional) indicated in this information. The company has governed the relationship with these companies as Data Processor
- Companies that carry out activities of transmission, enveloping, transport and sorting of communications to customers.
- Companies that carry out archiving services for documentation relating to relationships with customers.
- Debt collection company.
- Subjects (even outside the EU) who carry out services of organization and sale of tourist packages and tourist services with which Bluvacanze has stipulated/will stipulate commercial agreements for the execution of the instructions received from you, or, for the provision of services from you required (hotel facilities, airlines, tour operators, etc.).
- For needs strictly related to maintenance and management also by subjects who perform management, processing and maintenance services of management software and databases. the company has governed relations with these companies as Data Processor.
- For travel to non-EU countries and outside those indicated above for which there is no decision of Adequacy by the European Commission pursuant to art. 45 and/or art. 46 of EU Reg. 2016/679, it should be noted that travelers will not be able to exercise the rights as provided for by the Regulation either towards the Data Controller or Data Controllers, or directly towards third parties (such as, by way of example: hoteliers, local carriers, local insurance companies, public or private healthcare institutions, etc.) since this obligation to process and\or store data according to European Union standards is not envisaged by the laws of the host country; nevertheless, where the chosen destination is to these countries, by signing this proposal, they expressly express their consent to the sending of data to them, while being aware of the impossibility of exercising the rights provided for by European legislation. By signing this proposal, the traveler therefore acknowledges and accepts this lack of recognition of adequacy by the European Commission of the personal data processing standards in the countries of holiday’s destination and nevertheless requests the booking and execution of the trip. In the event of non-acceptance by the Organizer of this offer for the sale of a package \t ourist service, the personal data contained therein will be deleted, unless you do not authorize the processing for commercial purposes, such as receiving commercial offers (etc.) with express consent or refusal, by marking the appropriate box.

Retention period: We inform you that, in compliance with the principles of lawfulness, limitation of purposes and minimization of data, pursuant to art. 5 of the GDPR, the retention period of your personal data is:
- established for a period of time not exceeding the achievement of the purposes for which they are collected and processed for the execution and fulfillment of the contractual purposes
- established for a period of time not exceeding the achievement of the purposes for which they are collected and processed and in compliance with the mandatory times prescribed by law
- for marketing activities, until you decide to revoke your consent, where applicable, or until when you do not decide to exercise your right to object to the processing.

You have the right to obtain from the owner the cancellation (right to be forgotten), limitation, updating, rectification, portability, opposition to the processing of personal data concerning you, and in general you can exercise all the rights provided by the articles 15, 16, 17, 18, 19, 20, 21, 22 of the GDPR by writing to rpdblu@bluvacanze.it. . You have the right to lodge a complaint with the Supervisory Authority

Rights of the interested party
1. The interested party has the right to obtain confirmation of the existence or not of personal data concerning him, even if not yet registered, and their communication in an intelligible form.
2. The interested party has the right to obtain the indication:
to. the origin of the personal data;
b. of the purposes and methods of the treatment;
c. of the logic applied in case of treatment carried out with the aid of electronic instruments;
d. of the identification details of the owner, of the managers and of the designated representative (Article 5, paragraph 2)
And. of the subjects or categories of subjects to whom the personal data may be communicated or who can learn about them as designated representative in the territory of the State, managers or agents.
3. The interested party has the right to obtain:
a. updating, rectification or, when interested, integration of data;
b. the cancellation, transformation into anonymous form or blocking of data processed unlawfully, including data whose retention is unnecessary for the purposes for which the data were collected or subsequently processed;
c. the attestation that the operations referred to in letters a) and b) have been brought to the attention, also as regards their content, of those to whom the data have been communicated or disseminated, except in the case in which this fulfillment is proves impossible or involves the use of means manifestly disproportionate to the protected right;
d. data portability.
4. The interested party has the right to object, in whole or in part:
a. for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection;
b. to the processing of personal data concerning him for the purpose of sending advertising or sales material directly or for carrying out market research or commercial communication.
